anyway, with wade gone, the case moves on. i'm harris faulkner and you are in "the faulkner focus." arguments are underway on motions to dismiss the case from trump's attorneys and one of the co-defendants. trump wants to throw the case out entirely. his attorneys cite the first amendment and since he served as president his speech is political speech. the most properect theed speech under the constitution. one of trump's co-defendants attorneys with this. >> the freedom to associate, freedom to petition to government and the freedom to speak. all the conduct part of this indictment is covered by the first amendment. if you think about it, it makes sense that a judge should be the one that protects that right. you shouldn't have to go in front of a jury to protect your constitutional rights. >> harris: jonathan serrie is outside the courthouse. >> good morning. in addition to that first amendment issue regarding former president trump, that attorney we just saw representing one of

the co-defendants also took issue with the wording of the indictment. take a listen. >> when you look at the indictment you see a lot of language that says fake electors, things like that. dulyly elected, fraudulent. those are legal conclusions. we're trying to have those dismissed saying the state can't just put those legal conclusions in there. that's something that a jury has to decide. >> this is the first hearing in the georgia trump case since march 15th when special prosecutor nathan wade resigned from the case as a condition for district attorney fani willis to continue prosecuting it. >> he was more involved i think with witnesses and negotiating plea agreements. very important work but not the kind of stuff we would see in the courtroom in oral arguments. i don't see anything changes how the district attorney presents their case in the courtroom. >> bill: several defense attorneys have said the judge's

ruling earlier this month didn't go far enough by giving fani willis that option to remain on the case. so the defense is expected to appeal that judge's order. >> harris: all right, jonathan, thank you very much. andrew is here, former federal prosecutor and u.s. military veteran. great to see you today. all right. we're back in court on this one. what do you think about trump and the co-defendant's argument about the most protected type of speech, political speech. >> today is all about the first amendment. these are things i argue all the time in court. when the argument of the prosecution is all based on what donald trump said. we have to look at what the first amendment really protects. it protects everything that is short of it being criminal speech. that includes wrong speech, it includes outrageous speech, it includes ridiculous speech. when donald trump is engaged back a few years ago in his discussions about the election and the outcome of that

election, the prosecution has to do more than just prove that he was wrong in his statements. that speech has to actually be criminal conduct. not just circular speech in its right. if you rob a bank, the direction to somebody to rob a bank, that could be criminal. simply saying i would like $1 hundred thousand isn't criminal speech even if you say it in an aggressive or a directed tone. then you put that into a political bubble and that's even more protected because people who are engaged in that political speech are allowed to say things that really do butt up against the fringe. it seems basic. >> harris: how long do you think it will take to make that basic argument? >> the argument is going on in court right now. judge is in a tough position. when the judge rules on that in the course of a criminal trial is not clear. there is can you look at it based on the indictment alone and the judge make a ruling or does the judge have to have facts come in during the course of the trial and make the ruling

as the facts develop? that's the tough place. right now we're in a premature place to see the judge come back with a dramatic ruling for donald trump and ruled against some of the co-defendants on a similar motion in the past. >> harris: he has to be one of the most recorded people right now on the planet in terms of his speech, donald trump. whenever he speaks. so i can't imagine they need very many facts brought into the case whether or not he actually engages in political speech. >> i see that point. the point being, though. >> harris: i'm just stating the fact. >> we know what he said and clear what he said. the question is does that violate the law? that was the argument this morning whether the judge can reach that determination at this point. donald trump has repeatedly said that this is protected speech. there is very strong arguments for that. we have to turn back to how the criminal code actually applies to the judge looking at this. this may not be the point this happens. >> harris: fani willis, they can

appeal. what do you think happens with that? >> well, the appellate court is going to defer to what the trial judge said. but the trial judge in this case when you look at the ruling that he reached, he is very critical of the law, kind of confused what the precedent is. he says that effectively in his motion in his ruling and he also says that he isn't particularly confident in his ruling or at least words to communicate that. i think the appellate court will step in that they support the ruling he made or draw some sort of line in the sand as to where the law perhaps need to be clarified. we're a couple months away from hearing a decision from the appellate court on that. they have 45 days to reach their determination whether they will make that decision. but the appellate court does have an important point to make because the trial judge seemed uncertain and we need further clarification. that's why the trial judge certified that to the appellate

court, i think. >> harris: she kicked her ex off the case and see how the case holds together. california judge seems skeptical during arguments to dismiss hunter biden's nine federal tax charges yesterday. his attorney abbe lowell ripped the prosecution as vindictive and spurred by political pressure from republicans. the judge said there was 0 evidence for his claim. the prosecution argued the defense has no argument and has resorted to simply attacking the prosecutors. the judge said he will decide by april 17th. former acting attorney general matt whitaker and attorney leo terrell in agreement on the chances. watch. >> it is highly unlikely. all the arguments that lowell is making are about 80% accurate. it sounds good when it is reported or newspaper article, but it actually under the law is not exactly accurate. >> abbe lowell saying it is

under gop political pressure and there is a deal that was in place that was never basically completed between the government. so it is going to be the motion for dismiss will be denied. >> harris: the indictment accuses hunter biden spending money on anything but his taxes trying to avoid paying and cooking the books of his business and up against gun charges in delaware. court date for that is set for early june. we'll need a larger than 70 foot wall with all the cases against hunter biden and we haven't moved very far on any of this. >> he does have his day in court coming up quickly. the summer will be about hunter biden's trials. both of them that we're expecting to be dealt with. when matt and leo say that there is not a high chance that the case will be dismissed, i agree with that. the problem is with hunter biden's overwhelming evidence of his criminality, we have to look at how badly david weiss has

messed up this case along the way. delaying for years and years, then creating the sweetheart deal that jeopardized the case and now when we actually look at the case in california, there are many arguments that abbe lowell is making and he is a fantastic attorney and working hard for his client. all of them go back to the points of what was appropriate along the way, even calling into question whether david weiss was appropriately appointed as special counsel. both sides have been critical of david weiss being elevated to this position of special counsel. >> harris: wasn't he a federal attorney in the home state delaware of both the president and his son at some point? >> the u.s. attorney for delaware and -- >> harris: there might be conflicts of interest. >> d.o.j. regulations say special counsel aren't supposed to come from employees within the d.o.j. a little wiggle room there. we have somebody who is compromised based on the sweetheart deal, the years it

>> harris: divers found the bodies of two of the six workers on baltimore's francis scott key bridge when it crashed into the river below. it is a recovery looking for the bodies of those other four. there are major safety and economic concerns over the deadly bridge collapse and it

grows by the hour. every day they are missing out on their economy a lot of money. some of the containers on that ship that hit the key bridge were carrying hazardous materials. 764 tons. the containers broke, some of them, and chemicals are seeping into the water. transportation secretary pete buttigieg said this, fox business's grady trimble near the collapse site. grady? >> at least ten ships were rerouted from here to the port of baltimore to other ports according to the ship tracker marine traffic and as we talk about where the ships are going to go, if not here, the governors of new york and new jersey put out a joint statement and here is what they say about their port authority saying it can take on additional cargo and have directed the authority to further evaluate all available resources to minimize supply chain disruptions. here in baltimore, the bridge is

an update immigration and customs enforcement or ice just gave its update on its latest nationwide crack down. as they try to tout all that success the facts on the ground tell a very different story. border patrol data show ice deported fewer than 5% of all illegal border crossers who entered the country last year. a dramatic drop from the 30% sent back during the trump administration. and according to a recent report, immigration judges dismissed the deportation cases of 200,000 because the dhs had messed up the paperwork. murders are taking notice of all of it. fox polling shows 2/three disapprove of the job the president is doing on immigration and they trust trump on this issue again double digits plus 18% for trump.

upwards of 50 years. he was looking for a much more minimal sentence. he did exercise his allocution rights. he came before the court and apologized and talked about how difficult this has been. the judge recognized his autism and some of the other matters of mitigation that he raised. i think this is splitting it right down the middle, 25 years being half of what the government was looking for. >> harris: it is a statement? >> not so much a statement as much as a reflection of the facts here. the government going for 50 years is -- would have been a heavy sentence. this shows that there were pieces of mitigation here. >> harris: and that there were victims definitely. andrew, thank you. twice this hour. appreciate you scooting in on the breaking news.
